Public Comment Policy
The Pennsylvania Sunshine Act (65 Pa. C.S. 701, et seq.) provides that the Board or Council of a political subdivision shall provide a reasonable opportunity at each advertised regular meeting and advertised special meeting for residents of the political subdivision or for taxpayers of the political subdivision or to comment on matters of concern, official action or deliberation which are or may be before the Board or Council prior to taking official action. (710.1).
To assure compliance with the Act, to inform members of the public who may wish to make comment, and to provide for predictable and orderly implementation of the public comment period, Somerset Borough Council has adopted this Public Comment Policy.

*Council has traditionally rescheduled its November and December meetings based on the timing for budget adoption and the Thanksgiving and Christmas holidays. The rescheduling will be done closer to these dates.
Borough of Somerset Council Meeting
June 25th, 2018 at 7:00 p.m.
Meeting was called to order by President Ruby Miller, opening with recitation of the Pledge of Allegiance to the Flag.
Roll Call:
Council Members Present: Ruby Miller; Fred Rosemeyer; Pam Ream; Sue Opp; Steve Shaulis. Mayor Scott Walker also present. Junior Council Member Maria Weimer was present
Absent were Council Members Judy Pyle and Gary Thomas.
Also present were the following: Borough Manager, Michele Enos; Director of Finance, Brett Peters; Solicitor James Cascio; Chief of Police, Randy Cox and Consulting Engineers, Tom Reilly and Jake Bolby.

Approval of Minutes of Previous Meetings:
(a) May 14th, 2018 – Committee of the Whole Meeting Minutes

Mr. Rosemeyer moved, Mr. Shaulis seconded to approve the May 14th, 2018 Committee of the Whole Meeting Minutes.

Award of Bids:
(a) 2018 Paving Bid – Award bid to the lowest responsive bidder.
Ms. Enos stated that a bid was received from New Enterprise Stone and Lime for the Paving Project. She mentioned that they were the only bidder for this project.
Ms. Enos stated that Council was being asked to approve the “per ton” unit price cost. The estimate from PennDOT is about $18,000.00 over what was budgeted. Ms. Enos mentioned that we’ll take that down to where we need it to be to stay within budget.
Ms. Enos brought out that “scratch and leveling course” is $79.45 per/ton. “Wearing course” at 9.5mm is $79.70 per/ton. “Wearing course 19” is $75.15 per/ton, with the milling of the pavement at $335 per/square yard. Milling of paving notches is $4.10 per/linear feet. Ms. Enos, again, expressed that they will make sure to stay within budget.

Mrs. Ream moved, Mrs. Opp seconded to approve the “per ton” unit prices for paving costs.

(b) 2018 Seal Coat Bid - Award bid to the lowest responsive bidder.
Ms. Enos stated that we also had only one bidder for the Seal Coat Project. We received that bid from Russell Standard Corporation.
Ms. Enos brought out that they were again asking Council for the award to be based on the unit price, which is $44.50 per/square yard. She mentioned that this is within budget.

Mrs. Opp moved, Mr. Rosemeyer seconded to approve the “per square yard” unit price for seal coat costs.

Mrs. Opp moved, Mrs. Ream seconded, to approve the payment of bills numbered
31296 – 31443 totaling $441,728.32.

(a) Resolution No. 2018-11 – Consider the execution of a Winter Traffic Services
Agreement with PennDOT for North and South Franklin Avenue through the year 2023.
Ms. Enos stated this is for a five-year agreement with PennDOT, which is typically done on an annual basis. She mentioned that PennDOT just started with the five-year agreements.
Ms. Enos stated that what PennDOT is offering is a 4% increase from last year, which amounts to $4,214.64 for winter maintenance of plowing and salting. She stated that when we have a larger snow storm, PennDOT adjusts the amount accordingly, as well, and provides additional monies to the Borough in that regard.

Mrs. Opp moved, Mr. Rosemeyer seconded, to approve Resolution No. 2018-11, agreeing to the execution of a Winter Traffic Services Agreement with PennDOT for North and South Franklin Avenue through the year 2023.

Winter Traffic Services Agreement with PennDOT for North and South Franklin Avenue through year 2023
BE IT RESOLVED, by authority of the Borough Council of the Borough of Somerset,
Somerset County, and it is hereby resolved by the authority of the same, that the
Borough President of said MUNICIPALITY be authorized and directed to sign the
attached Agreement on its behalf.
Mrs. Miller thanked everyone who had worked very hard to help during our most recent rain storm.
Ms. Enos expressed her thanks to Mr. Shaulis for responding during the day, when she brought out, is the most difficult time to get people to respond.
Mr. Shaulis mentioned that he’s fortunate the school cooperates with him to let him leave work to respond to the Boroughs needs.
Executive Session – To discuss potential litigation.
